Judicial Independence: A Statement from the Maryland Hispanic Bar Association

Dear MBHA members, friends, and colleagues,


The Maryland Hispanic Bar Association is composed of attorneys, legal  professionals, and college and law students dedicated to the pursuit of justice. We  firmly believe that one of the greatest pillars of our democracy is respect for the  rule of law.


For over 200 years, the United States has thrived under the rule of law. The  Legislative Branch enacts laws, the Executive Branch enforces them, and the  Judicial Branch interprets them. Our forefathers purposely divided these powers to  prevent the nation from descending into the tyranny they had fought so hard to  overcome. The rule of law provides a legal mechanism to resolve disputes,  including an appellate process to address disagreements with judicial decisions. The rule of law ensures laws are enforced fairly and consistently, whether you're  an indigent client or a corporate leader. It ensures accountability for all.


For the rule of law to function effectively, it requires that everyone respect the  process. As citizens and residents of the United States, it is our collective duty to  follow the laws set forth in statutes and precedents. When we violate these laws,  we must accept the consequences. If anyone - especially those leading our country  - disregards the rule of law, our entire system, and our democracy, will collapse.


In recent years, we have witnessed a disturbing increase in threats and acts of  violence against judges. Judges have been attacked, threatened, and even killed  simply for performing their duties. In recent weeks, the current administration has  called for the impeachment of federal judges who ruled contrary to its interests. An  official from the administration went so far as to publicly release the personal  information of a judge's daughter following an unfavorable ruling. In February,  several prosecutors resigned after being forced to dismiss cases unethically to align  with the administration’s policies.. Most recently, the administration has failed to  abide by federal and Supreme Court decisions and has questioned whether they are  obligated to follow the constitution.


These actions undermine public trust in the judicial system and endanger judicial  independence. The retaliatory actions of the current administration and its agents  against attorneys and judges threaten the integrity of our justice system.


The Maryland Hispanic Bar Association calls on leaders at all levels of government,  along with all citizens and residents, to protect, defend, and preserve the rule of law  for future generations. We must do everything we can to maintain the independence  of each branch of government and ensure they continue to provide oversight for  one another. Preserving democracy means upholding justice, and safeguarding the  rule of law is a fundamental right for all future Americans.
